This AI Acceptable Use Policy ("AUP") constitutes a binding legal agreement between You and DEVART LTD ("Devart dbForge", or "We", or "Us").
By accessing and/or using Our AI Product(s), and/or giving your consent by clicking the respective "I agree" button (or as another similar wording may be available) when You access or use, or register/connect to the AI Product(s) through any mobile phone, tablet, computer, or another device, you as a User ("You", or "User") of the AI Product(s), confirm that You have read, understand and agree to be bound by Our AI Product(s) Terms and Conditions and this AUP which are incorporated by reference into this agreement with You (this "Agreement"), and all other related documents, policies, and terms and conditions, and any applicable laws relating to our relationships.
This AUP constitutes an addendum to Our AI Product(s) Terms and Conditions and shall be construed in conjunction with the definitions and terms set forth in Our AI Product(s) Terms and Conditions.
We may change this AUP at any time without notice, immediately effective upon posting such changes to the Website. Continued use of the AI Product(s) will be deemed Your acceptance of the revised AUP. We may notify You about the updates to this AUP, but We assume no obligation for such notification. Therefore, We encourage You to periodically check this AUP for any updates.
If You disagree with this AUP, please do not use Our AI Product(s).
1. Compliance With Laws and Regulations
1.1. You agree to use Our AI Product(s) in compliance with all applicable laws, regulations, and governmental policies, including but not limited to:
1.1.1. Data protection and privacy laws, such as GDPR, CCPA, and other relevant regulations.
1.1.2. Intellectual property laws, ensuring that You do not infringe on any and all of our copyrights, trademarks, or other proprietary rights, or third parties.
1.1.3. Export control and sanction regulations that prohibit the use of Our AI Product(s) in restricted jurisdictions or by sanctioned entities.
2. Prohibited Uses
2.1. You shall not use Our AI Product(s) in any way or submit to Us or the AI Product(s) anything that in any respect:
2.1.1. Violates any law, statute, regulation, or by-law of any applicable jurisdiction
2.1.2. Is fraudulent, criminal, or unlawful, including engaging in activities such as identity theft, scams, or phishing
2.1.3. Is inaccurate, misleading, or out-of-date in a way that could cause harm or deception
2.1.4. Contains obscene, indecent, pornographic, vulgar, profane, racist, sexist, discriminatory, offensive, or hateful content
2.1.5. Impersonates another person or entity or misrepresents a relationship with any person or entity
2.1.6. Infringes upon copyrights, trademarks, intellectual property rights, privacy, or other rights of Us or any third party
2.1.7. Attempts to deliver or transmit viruses, malware, or other harmful code intended to damage, interfere with, or intercept any system, data, or personal information
3. Additional Specific Prohibited Uses
3.1. Without limiting the foregoing, You specifically agree not to use the AI Product(s) to:
3.1.1. Generate, create, or distribute content that has:
3.1.1.1. Explicit sexual content, including pornography or sexually explicit material involving real or fictitious persons
3.1.1.2. High risk of physical harm, including: weapons development, military use and warfare, espionage, use for materials or activities that are subject to the International Traffic Arms Regulations (ITAR) maintained by the United States Department of State, development, management or operation of critical infrastructure in energy, and water, and in operation of transportation technologies or generation of content that promotes, encourages, or depicts acts of self-harm, such as suicide, cutting, and eating disorders
3.1.1.3. High risk of economic harm, including multi-level marketing, gambling, payday lending, automated determinations of eligibility for credit, employment, educational institutions, or public assistance services
3.1.1.4. High-risk government decision-making, including law enforcement and criminal justice, migration, and asylum
3.1.1.5. Engagement in the unauthorized or unlicensed practice of any profession, such as offering tailored legal, medical, accounting, or financial advice
3.1.1.6. Misleading claims of expertise or capability made particularly in sensitive areas (e.g., health, finance, government services, or legal)
3.1.1.7. Political campaigning or lobbying by generating campaign materials, building conversational or interactive systems such as chatbots that provide information about campaigns or engage in political advocacy or lobbying, or building products for political campaigning or lobbying purposes
3.1.2. Represent that the Output was a human-generated or original work when it was not
3.1.3. Engage in activities designed to manipulate, deceive, or defraud others, including but not limited to generating false information, scams, or phishing content
3.1.4. Bypass or circumvent any technical safeguards or content moderation systems implemented on the Website
3.1.5. Send Us any personal information of children under the age of 13 (thirteen) or the applicable age of digital consent, uploading or generating any child sexual abuse material or any content that exploits or harms children, or harming minors or interacting inappropriately with people under 13 (thirteen) years of age in any other way
3.1.6. Make automated decisions in domains that affect material or individual rights or well-being (e.g., finance, legal, healthcare, housing, insurance, and social welfare)
3.1.7. Use automated scripts, bots, or other unauthorized means to extract data from Our AI Product(s)
3.1.8. Assist or promote violence, terrorism, or illegal activities, including radicalization, incitement to violence, or coordination of criminal actions
3.1.9. Engage in discriminatory practices, including but not limited to content that promotes hate speech, discrimination, or targeted harassment
3.2. This list of prohibited uses and rules of conduct is not meant to be exhaustive. This includes, but is not limited to, automated decision-making in legal, financial, healthcare, housing, insurance, and social welfare contexts, where such decisions could have significant consequences for individuals or organizations. Users must ensure human oversight and review before acting on AI-generated recommendations in these areas. We reserve the right to determine what conduct We consider to be a violation of this AUP and take appropriate action.
4. User Responsibilities and Security
4.1. You are responsible for maintaining the confidentiality of Your account credentials and preventing unauthorized access.
4.2. You shall not attempt to reverse engineer, decompile, or disrupt the AI Product(s) or its security measures.
4.3. You must promptly notify Us in writing via Our customer support at [email protected] if You become aware of any unauthorized access, security breach, or violation of this AUP.
5. Accuracy
5.1. We do not guarantee or warrant the accuracy, completeness, or reliability of any content generated by Our AI Product(s), including the content and filling of Output(s). While We continuously strive to improve the quality and precision of AI-generated outputs, You acknowledge and agree that:
5.1.1. Generated content may not always be accurate or reliable. You should not rely on AI-generated content as the sole source of factual information, legal guidance, medical advice, financial recommendations, or any other professional consultation.
5.1.2. You are responsible for verifying AI-generated content before using, sharing, or acting upon it. We strongly recommend exercising human review and discretion to assess the accuracy and appropriateness of any AI-generated material.
5.1.3. AI-generated content does not necessarily reflect Our views or opinions. The outputs produced by Our AI Product(s) are generated based on algorithmic processing and do not represent Our official stance on any topic.
5.1.4. If AI-generated content references third-party products, services, or organizations, such references do not imply endorsement or affiliation. We do not verify the accuracy of such references, and You should independently evaluate any third-party information before acting upon it.
5.2. By using Our AI Product(s), You acknowledge and accept these limitations and agree to use the AI-generated content responsibly.
6. Territorial and Jurisdictional Restrictions
6.1. Our AI Product(s) may not be available for use in certain jurisdictions due to legal or regulatory restrictions. We disclaim any liability for AI Product(s) unavailability in such jurisdictions.
6.2. You are responsible for ensuring that Your access and use comply with the laws of Your location.
6.3. We reserve the right to deny or restrict access based on applicable laws and compliance obligations.
7. Enforcement and Consequences
7.1. We reserve the right to suspend or terminate Your access if We determine a violation of this AUP.
7.2. We may implement technical measures and human review processes to detect and prevent prohibited uses described in this AUP.
7.3. If We ascertain or receive information from third parties or law enforcement officials about a violation, We may:
7.3.1. Terminate Your access to the AI Product(s) and/or delete Your Account without notice
7.3.2. Report such activities to relevant authorities if required by law
7.3.3. Seek reimbursement for any damages, costs, or legal expenses incurred due to Your breach
By using Our AI Product(s), You acknowledge and agree to be bound by this AI Acceptable Use Policy. Failure to comply may result in immediate action, including termination of services, legal enforcement, or other appropriate measures.

8.1. Notices relating to this AUP may be sent to You via email to the email address or by SMS to Your phone number that You used for connecting to/registering on the Website, or provided to Us otherwise. You expressly authorize Us to contact You via such email or phone number in the event We are required by law to notify You of a data security incident or data breach.
